Terms of Service

1. Acceptance of Terms

Welcome to Case Agentic, Inc. ("Case Agentic," "Company," "we," "our," or "us").

These Terms of Service ("Terms") govern your access to and use of the Case Agentic website, software platform, applications, and related services (collectively, the "Services").

By creating an account, purchasing a subscription, or accessing the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement.

By using the Services, you represent that you have the authority to do so.

3. Description of Services

Case Agentic provides a cloud-based software platform designed to help organize, manage, and streamline documentation, workflows, and communications relating to VA disability claims and related services.

Case Agentic is a technology platform only.

Case Agentic does not:

  • provide legal advice;

  • provide medical advice;

  • guarantee VA claim approval;

  • act as the Department of Veterans Affairs;

  • replace licensed professionals or accredited representatives.

Users remain solely responsible for all information submitted through the platform and all professional decisions made using the Services.

4. User Accounts

You are responsible for:

  • maintaining the confidentiality of your login credentials;

  • all activity occurring under your account;

  • providing accurate information;

  • notifying us immediately of unauthorized access.

We may suspend or terminate accounts that violate these Terms.

5. Subscription Plans

Certain Services require a paid subscription.

Subscriptions may be offered on either:

  • Monthly billing

  • Annual billing

Subscription pricing is displayed at the time of purchase and may change for future subscription periods upon advance notice.

6. Billing and Payment

Subscriptions renew automatically unless canceled in accordance with these Terms.

By purchasing a subscription, you authorize Case Agentic to charge your selected payment method for all applicable subscription fees, taxes, and authorized charges.

Failure to maintain a valid payment method may result in suspension or termination of Services.

7. Cancellation Policy

Monthly Plans

Monthly subscriptions require 30 days advance written notice before cancellation.

Cancellation requests must be submitted by email to subscription@caseagentic.com.

Your subscription will remain active during the 30-day notice period, and applicable charges may continue during that period.

Annual Plans

Annual subscriptions may be canceled at any time by emailing subscription@caseagentic.com.

Cancellation prevents future renewal billing.

Your subscription will remain active until the end of the prepaid annual subscription term.

Access to the Services will automatically terminate at the expiration of the paid term.

8. Refund Policy

All subscription purchases are final.

Subscription fees are:

  • non-refundable;

  • non-transferable;

  • not subject to prorated refunds;

  • not eligible for credits for unused time.

No refunds will be issued for partial months, partial years, unused Services, or voluntary cancellation.

9. Acceptable Use

You agree not to:

  • violate any law or regulation;

  • upload malicious software;

  • interfere with platform security;

  • attempt unauthorized access;

  • impersonate another person;

  • use the Services for fraudulent purposes;

  • misuse protected health information or confidential information.

10. User Content

You retain ownership of all information and documents you upload.

You grant Case Agentic a limited license to host, process, store, transmit, and display your content solely for providing the Services.

You represent that you have all necessary rights and permissions to upload the information you submit.

11. Intellectual Property

All software, trademarks, logos, workflows, designs, documentation, and proprietary technology used by Case Agentic remain the exclusive property of Case Agentic, Inc.

Nothing in these Terms transfers ownership of our intellectual property.

12. Privacy

Your use of the Services is governed by our Privacy Policy, which explains how we collect, use, and safeguard information.

13. Service Availability

We strive to maintain reliable access to the Services but do not guarantee uninterrupted availability.

Maintenance, upgrades, internet outages, third-party failures, or unforeseen events may temporarily affect access.

14. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis.

To the fullest extent permitted by law, Case Agentic disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee:

  • uninterrupted service;

  • error-free operation;

  • successful VA claims;

  • specific business outcomes.

15. Limitation of Liability

To the fullest extent permitted by law, Case Agentic shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from your use of the Services.

Our total liability for any claim shall not exceed the amount you paid to Case Agentic during the twelve (12) months preceding the event giving rise to the claim.

16. Indemnification

You agree to indemnify and hold harmless Case Agentic, its officers, employees, contractors, affiliates, and partners from any claims, damages, liabilities, losses, or expenses arising from:

  • your use of the Services;

  • your violation of these Terms;

  • your violation of applicable law;

  • your infringement of another person's rights.

17. Suspension and Termination

We reserve the right to suspend or terminate accounts for:

  • violation of these Terms;

  • fraudulent activity;

  • unlawful conduct;

  • security risks;

  • misuse of the platform.

Termination does not relieve you of any payment obligations incurred before termination.

18. Modifications

We may update these Terms from time to time.

Material changes will become effective upon posting the revised Terms with an updated Effective Date.

Continued use of the Services constitutes acceptance of the revised Terms.

19. Governing Law

These Terms shall be governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

Any legal action arising under these Terms shall be brought in the state or federal courts located in Delaware.
